DMX batting a thousand Earl is not in it to win it: Troubled rapper DMX is facing his sixth arrest in 2008 after failing to attend a court hearing in Phoenix, Arizona on Tuesday. The 37-year-old was due to face a felony drug charge, but failed to show, prompting Commissioner Phemonia Miller to issue a bench warrant for his arrest. DMX - real name Earl Simmons - has spent most of the year in and out of custody and court over a series of legal woes. In July, he pleaded not guilty to felony charges of theft and identity theft after he was accused of using a false identity to avoid paying medical bills.
